Terms of Service

You must be at least 18 years old and have the authority to act on behalf of the business you sign up under. By creating an organization, you represent that the business information you provide is accurate and that you are authorized to create a Callgenee account for that business. We may ask you to confirm your email address before you can invite other people to your organization, and we may suspend an organization we reasonably believe was created without proper authorization or under false pretenses.

Each organization is its own isolated account ("tenant"). The person who creates an organization is its first Admin and can invite additional Admins and Staff users. Admins are responsible for managing who has access to their organization, for the accuracy of information they enter, and for keeping login credentials confidential. You're responsible for all activity that happens under your account, whether or not you personally performed it.

We may suspend or terminate an account that violates these Terms, that we reasonably believe is fraudulent or unauthorized, or that we're required to act on by law.

New organizations receive a 14-day free trial with full access to the Service. After the trial ends, continued access requires upgrading to a paid plan. As of this writing, plan upgrades are handled manually — contact us to upgrade, and we'll activate your organization once payment is arranged outside the app. This section will be updated once self-service online payment is available, at which point it will describe billing cycles, automatic renewal, and refund/cancellation terms.

We may change our pricing with reasonable advance notice to active paying customers; changes won't apply retroactively to a billing period you've already paid for.

You agree not to use the Service to:

• Violate any law, or the privacy or other rights of any person;
• Upload malicious code, or attempt to gain unauthorized access to the Service or another organization's data;
• Impersonate a business or person you have no authority to represent;
• Store customer/lead data you weren't authorized to collect or use unlawfully (for example, in violation of telemarketing or texting consent laws that apply to your business); or
• Resell or provide the Service to third parties without our written permission.

Everything you and your team enter into Callgenee — lead and contact records, pipeline configuration, notes, activity logs — belongs to your organization. We don't claim ownership of it, and we don't use it to train models, sell it, or share it with other organizations. We process it on your behalf to provide the Service, as described in our Privacy Policy.

You're responsible for the lawfulness of the contact information and lead data your organization enters — including having any consents required to contact those people by phone, text, or email under laws that apply to your business.

When a user is removed from an organization, their record is hidden and their login disabled, but their historical leads and activity are retained so your team's records stay intact. If you need data permanently deleted, contact us.

We aim to keep Callgenee available and reliable, but we don't guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Callgenee and The Speaker Crafters LLC won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose (or $100 if you haven't paid us anything).

You may stop using the Service at any time. We may suspend or terminate access to the Service for any organization that violates these Terms, doesn't pay applicable fees, or for prolonged inactivity, with notice where reasonably practical. Sections of these Terms that by their nature should survive termination (including data handling, limitation of liability, and governing law) will survive.

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify Admins by email. Continued use of the Service after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws principles, unless a different law is required by the jurisdiction you're located in.
